Annexation

ANNEXATION AGREEMENT

An Annexation Agreement is essentially a “contract” that indicates that a property outside the City limits agrees to annex into the city at a certain time and with certain
conditions. The property may or may not be contiguous to the current city limits.

Agreement can be either “basic” or “enhanced”.

  • Basic Agreements: Basic agreements are those that do not have any special negotiated terms such as zoning, financial incentives, etc. They simply
    identify that the property owner and the City have agreed to have the property annexed at a given time. Basic Annexation Agreements are most common for property in the mile-and-a-half that are not contiguous to the city limits and which need a sewer connection from the UCSD.
  • Enhanced Agreements: Enhanced agreements are those where specific terms are negotiated such as rezoning the property upon annexation, development incentives, other zoning variances, etc.

ANNEXATION PETITION

An Annexation Petition is the legal means by which a property is annexed. It is simply a one to two-page document that identifies the property, indicates that the Owner of the property desires the City to immediately annex the property and then provides a notarized signature from the owner.

Contiguous vs. Non-Contiguous Properties

If property is contiguous to the city limits, an annexation petition can be prepared and the property can be annexed without the need for an agreement. Property that is not contiguous to the city limits cannot be annexed until such time that it becomes contiguous. In these cases Annexation Agreements are created and the Annexation Petition is prepared at a later date.

There is no fee to file a Petition for Annexation.


ASSISTANCE

It is strongly recommended to have a phone conversation or meeting with Planning staff (depending on the type of application) prior to an application being submitted.  This is an opportunity to find out what regulations and requirements are expected to be met and followed.  This includes what application(s) you will be required to apply and get approval for.  City staff will inform you what the process and time frame will be for getting application(s) for your intended plans reviewed and hopefully approved.
