In 1983, the City carried out the West Urbana Zoning Enforcement Project to address confusion regarding the zoning status of certain addresses in West Urbana. This project resulted in a comprehensive inventory of the 627 structures in West Urbana, distinguishing between uses that were legally nonconforming and those that were illegally nonconforming.
The "West Urbana Legally Non-Conforming Uses Inventory" and "West Urbana Legally Non-Conforming Uses Map" - both provided below - provide an record of legally nonconforming uses in the West Urbana neighborhood, as of 2013. Both the inventory and the map cover all addresses within the boundaries indicated on the nearby aerial photo: West Green Street (to the North), South Lincoln Avenue (to the West), West Florida Avenue (to the South), and South Race Street (to the East).
A nonconforming use is a use of land or a structure that does not comply with the current zoning regulations. Legally nonconforming uses are those that were in existence before the current zoning regulations were enacted and were in compliance with the previous zoning rules. These uses are allowed to continue under the current zoning ordinance. However, they cannot be expanded or extended beyond their current state. If a nonconforming use of a building, structure, or land is abandoned for a specified period or changed to a conforming use, it may lose its nonconforming status. Any subsequent use must then adhere to the regulations of the current zoning ordinance.
For more detailed information on Nonconformities, you can refer to Article X, titled "Nonconformities," in the Urbana Zoning Ordinance.
